General Terms and Conditions of the Anoa Online Shop

§ 1 - Provider, inclusion of the terms and conditions
(1) Provider and contractual partner for the goods presented in the Anoa Online Shop are the managing directors Stefanie Wick & Doreen Haverkamp, Bernhard-Schumacher Weg 22, 48268 Greven, e-mail hello@anoa-shop.com (hereinafter referred to as "Provider").
(2) These General Terms and Conditions are part of every contractual agreement between the Provider and the respective Buyer. Conflicting terms and conditions of the buyer are contradicted.

§ 2 - Offer of goods and conclusion of contract
(1) The buyer offers the items displayed in his Anoa Online Store to customers for purchase. The color representation of the items on the website may vary slightly depending on the internet browser used and the monitor settings of the purchaser; these deviations are technically never completely avoidable.
(2) The selection of goods, the conclusion of the contract and the execution of the contract shall be in German.
(3) The Provider delivers worldwide.
(4) The Buyer selects the desired goods by placing them in the "shopping cart" or by clicking on the shopping cart button. The order request can finally be transmitted to the Provider by clicking the button "order subject to payment". The customer has the possibility at any time up to the sending of his order request to view and change the data provided in the order or to cancel the order altogether.
(5) For the goods displayed in the Anoa Online Shop, the provider makes a binding offer to purchase. By sending the order request via the button "order with obligation to pay" the customer accepts the purchase offer. The provider confirms the conclusion of the contract by e-mail (contract confirmation).
(6) The content of concluded contracts is stored in the customer's Anoa user account and can be viewed by the customer in the Anoa Online Store at any time via the "Log in" menu under the item "My purchases".
(7) In case of delivery obstacles or other circumstances that would prevent the fulfillment of the contract, the supplier will inform the purchaser by e-mail.

§ 3 - Prices and payment
(1) All product prices are final prices plus shipping costs. The charges include 19% sales tax.
(2) The shipping costs are listed under the menu item "Payment and Shipping".
(3) Deliveries to Switzerland may be subject to customs duties and import sales tax, which must be paid by the buyer to the customs authorities upon receipt of the shipment. These charges are in addition to the purchase price and shipping costs and are not influenced by the provider.
(4) The provider delivers at the option of the buyer against prepayment by redeeming a voucher, against prepayment by bank transfer, against prepayment by means of PayPal payment, against prepayment by means of PayPal Plus payment or against prepayment by means of credit card. With the confirmation of the contract, the buyer receives by e-mail an Internet link that leads him to the area "My purchases", which contains further information on the purchase transaction.
a) For payment by voucher, the buyer can enter a voucher code. The voucher value will be credited to the supplier and the invoice amount will be settled in this way. If a voucher value is higher than the invoice amount, the voucher remains valid in the amount of the exceeding amount. Only one voucher is accepted per order. Several vouchers or even different vouchers can not be redeemed for one order. A cash payment of Anoa Online Shop vouchers is also excluded.
b) If the buyer has chosen "bank transfer" as payment method, the buyer will be informed of the provider's bank details in the order confirmation email. The provider accepts bank transfers from abroad only as payments in euros without charges. The money transfer in the case of a bank transfer, whether online or by bank transfer, must be completed within 10 days and can be between 1-3 days depending on the bank. If the payment does not arrive within 10 days, the order will be automatically canceled.
c) If the buyer has chosen "PayPal" as a payment method, he will get to the online service of PayPal via the button "Click here to pay with PayPal" and can initiate the payment there.
d) The Buyer may use a VISA or MasterCard credit card for prepayment. For their payment processing, the provider has commissioned WIX and authorized to receive money. The button "Click here to pay by credit card" leads the Buyer to a page set up by Wix, where he can initiate the payment.

 

§ 4 - Shipping, delivery times
(1) The Supplier shall deliver the goods within the time period specified in the respective product description.
(2) For products that are marked as "customizable" in the product description, the delivery time shall be increased by one week if the Customer orders such customization.
(3) For shipments to destinations outside Germany, the delivery time increases by a further 2-9 working days, depending on the destination country.
(4) Several products ordered at the same time shall be delivered in a joint shipment; the delivery time of the product with the longest delivery time shall apply to the joint shipment. If the customer wishes the delivery of a certain product with a shorter delivery time in advance, he must order this product separately. As an exception here, in the case of an Advent calendar order: so that the Advent calendar can be ordered earlier, but does not have to wait for the other ordered products, the other ordered products will be shipped within the regular delivery time.
(5) If the delivery to the Buyer fails because the Buyer has provided the delivery address incorrectly or incompletely, a new delivery attempt will only be made if the Buyer bears the direct costs of the new shipment. These costs correspond to the shipping costs agreed upon at the conclusion of the contract.
(6) If the Buyer has chosen cash payment as payment method, the goods will not be shipped. Instead, the Buyer may pick up the goods at the place of business of the Provider after the time specified in the product description has expired; for individualized products (see paragraph 2), the time until provision is extended by one week.

§ 5 - Consumer right of withdrawal
(1) A purchaser who buys as a consumer has a right of withdrawal according to the legal conditions. A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to his commercial nor to his independent professional activity.
(2) A consumer with permanent residence outside Germany shall be granted a 14-day cancellation period by the Provider even if the consumer's national law provides for a shorter period for this purpose.
(3) The Supplier grants a consumer with permanent residence outside Germany the right to send the notice of withdrawal informally even if the national law of the consumer provides for a stricter form.
(4) For consumers with permanent residence in Switzerland, the requirements and legal consequences of the German consumer right of withdrawal shall apply even if Swiss law does not provide for withdrawal.
(5) General note: Goods damaged by the buyer are excluded from revocation. This applies in particular to the Advent calendar, which are opened and / or damaged.  

§ 6 - Warranty
The warranty rights of the buyer are governed by the statutory provisions.

 

§ 7 - Privacy policy
(1) Upon conclusion of the contract, Anoa will transmit to the purchaser the Anoa username, name and billing address as they are stored in the purchaser's user account. If the buyer has provided further data in the context of his order (e.g. a different delivery address or a telephone number), these will also be transmitted.
(2) The provider processes the data referred to in paragraph 1 electronically for the proper fulfillment of the contract, in particular for shipping, invoicing and posting of payments. For the purpose of shipping, the provider may also transmit the name and address of the customer to the contracted shipping company.
(3) The Provider shall keep the data stored until all mutual claims arising from the order have been settled in full and the retention obligations for the Provider under commercial and tax law have expired.
(4) The Buyer may at any time request information from the Provider about the data that the Provider has stored about the Buyer. Furthermore, the Buyer may at any time request the correction of incorrect data.
a) The responsible party for data protection is the provider named in § 1 paragraph 1.
b) If the Buyer uses the PayPal service for payment, the PayPal data protection provisions shall apply additionally to the payment process. PayPal acts as a vicarious agent of the purchaser, not of the provider.
c) If the Buyer uses a payment method offered via Wirecard, Wirecard shall collect and process the Buyer's name, card or account number and/or other data required for the selected payment method. In this respect, the Wirecard data protection provisions shall apply in addition.
(5) Default in acceptance or payment
If the buyer does not accept the goods at the agreed place of delivery or does not pick up the goods in a reasonable time at the DHL parcel store, the Anoa Online Shop is entitled to withdraw from the contract after setting and unsuccessful expiration of a grace period of 14 days. In this case, the Anoa Online Shop is entitled to claim 12 percent of the gross price as liquidated damages in lieu of performance, unless the buyer proves that only a significantly lower or no damage has occurred. Anoa Online Shop reserves the right to claim higher damages.
(6) Retention of title
The delivered goods remain the property of Anoa Online Shop until full payment.
(7) Legal liability for defects
The provider is liable for defects of the goods according to the statutory provisions, in particular § § 434 et seq. BGB and the mandatory rules of the sale of consumer goods. The customer is entitled to a warranty only if Anoa Online Shop has given this separately. The buyer uses for the return as far as possible the original packaging. Anoa Online Shop expressly points out that the assertion of claims for defects and / or damages and the exercise of the right of withdrawal is not dependent on this.

§ 8 - Data Protection
Anoa Online Store will comply with all data protection requirements, in particular the provisions of the Telemedia Act. More information can be found in the Privacy Policy section.

 

§ 9 - Final provisions
(1) The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods. However, German law shall not apply to consumers with permanent residence abroad insofar as the consumer's national law contains provisions from which the consumer cannot deviate by contract.
(2) Should individual provisions of these general terms and conditions prove to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
